We hit these 3 magical keys in hopes of our computer STARTING OVER and erasing any damage that we could have caused.



I attended a Quest for Personal Leadership Seminar at Whitehead and Associates last year. My eyes were opened to a ton of things about myself that I needed to work on/modify in order to be more productive, content, and successful in my business and personal life. In contemplating what practices I was going to start to put in to play for this to take effect, the following came to my mind.

*****CONTROL***** YOUR THOUGHT PATTERNS

At times it can seem like the world is TOTALLY AGAINST US. The economy and all the change taking place globally can really be a de-motivator if thought upon for too long. Negative/”woe is me” individuals who constantly think that by complaining about a particular situation, it will somehow change. Watching loved ones and friends lose their jobs, their families, and their lives are enough to have you racing to the edge of the nearest bridge and praying the jump won’t be too painful.

CONTROL.

Situations are changing. YOU ARE NOT. You are still the same wonderfully talented, gifted individual. You have the power to create change JUST with your positive attitude and outlook. By your willingness to step up to the plate and not be dragged down, you are creating a ripple effect that will create other successful/positive people around you.

*****ALTER*****YOUR BUSINESS/PERSONAL PLAN

WE ARE WORKING HARDER AND LONGER THAN EVER to make a penny. WHY? We are doing the same thing we did 10 years ago and it doesn’t seem to be working the same way.

ALTER.

Change is tough. We love our comfort zones but now it’s time for a new plan. You were productive once, you can be again. What is the thing/mode of operation you are clinging to that can be let go? Reach out to people around you and shoot ideas back and forth. Different perspectives can be powerful and a creative title wave could ensue if you give yourself the chance to explore new ways of doing things.

We all have things that we have failed at. We all can also dwell on those failures and not move forward. We all have been successful on a number of levels. We can dwell on these successes as well and not be open to change.

DELETE.

Stop living in the past. Yesterday is gone, today is today and tomorrow is an opportunity waiting to happen. Always think in a “forward” motion. Always be open to new ideas and ways to do things. Keep your relationships diverse because diversity is always a teacher. Stop beating yourself up and LEARN from your mistakes and be thankful for the opportunity to start fresh. You have what it takes because of who you are!

I heard a rumor....and it's not about Charlie Sheen!!

At times, we all are faced with battling rumors whether it be about ourselves personally, our careers, or the industry that we are in. Real estate is a bit of a scary business right now with the impact the economy has had on us as well as all the changes that have occurred both on the lending side, legal side, and realtor side.





Law Avania has been experiencing some mudslinging and while we laugh at most of the rumors, we feel it is time to address the more outlandish with some humor and encouragement for our industry partners.

1. LAW AVANIA IS GOING OUTOF BUSINESS: THIS STATEMENT IS ABOUT AS TRUE AS THE ONE WE HEARD THE OTHER DAY ABOUT OSAMA BIN LADEN BEING A SOUTHERN BAPTIST. HAHA!!





As a matter of fact, Law Avania is GROWING. We plan to add an office in Lake Norman as well as add a FAMILY LAW practice in the next 90 days to expand upon our already increasing Real Estate, Short Sale, and Wills and Estate practice. 2. ARE YOU TAKING THE RIGHT PATH WHEN IT COMES TO NEGOTIATING DEFICIENCIES IN SHORT SALES?





REAL ESTATE AGENTS AND DEBT NEGOTIATION



With the large increase in the number of foreclosures in North Carolina and the increased number of properties being listed and sold as “Short Sales”, questions have been raised about the appropriateness and legality of real estate agents negotiating debt on behalf of their seller clients.



In looking at what real estate agents are not permitted to do in other areas, most, if not all, real estate agents know that under the rules of NCREC, an individual is permitted to purchase or sell a house for themselves, but if they engage in bringing buyers and sellers together for a fee, they must be licensed.



Similarly, if a real estate agent is performing BPO’s for lenders or mortgage companies, and being compensated for those opinions, and are not licensed appraisers, NCREC is turning these agents over to the North Carolina Appraisal Board for discipline.



It is also a clear and established rule that a real estate agent is not permitted to charge a fee to help a buyer obtain financing for the purchase of their new home, unless they are licensed by the North Carolina Banking Commission. To engage in this activity could constitute a criminal offense.



The same is true for persons, other than licensed attorney’s, to negotiate debt settlement on behalf of other individuals. North Carolina has codified the Unauthorized Practice of Law in N.C.G.S. 84, which prohibits individuals that are not licensed to practice law in North Carolina to represent others or to give legal advice. In addition to this statute, the Short Sale Addendum to the North Carolina Offer to Purchase and Contract states that “if a foreclosure or other judicial proceeding if filed with respect to the property, although the firm may continue to solicit and negotiate offers to purchase and contract, communicate with, obtain information and supply information to lien holder, firm may no longer negotiate the terms and conditions of a short sale with lien holder, as such negotiations would constitute the practice of law”.



In addition to the unauthorized practice violation, a real estate agent should be mindful of potential liability they create by negotiating debt on behalf of a client, especially if they have not been properly trained or have the necessary experience with short sales. Short Sales include having to have an understanding of liens and lien priority, Credit Reporting issues, and Tax Liability for their seller, any of which, if not handled properly can create liability for the real estate agent.



There is little doubt that real estate agents engaging in debt negotiations of behalf of seller clients are doing so with the best intentions of helping their seller. However, with the risk of both potential liability for negotiating debt, and the potential violation of the unauthorized practice statute, these activities can and should be handled by North Carolina licensed attorney.

CHANGES IN SHORT SALES


Recent Changes in Short Sales Impacting Real Estate Professionals. Law Avania Steps Up To Meet New Challenge.
